1. Scope of these terms
These Terms apply to the informational and marketing content on the Site, including technical articles, product pages, industry pages, the system-data questionnaire, and any calculators or configurators offered on the Site.
Purchases made through our online store at shop.restrictflow.com are governed by the store's Terms of Service, Refund Policy and Shipping Policy, which are posted on that store. Engineered products and services quoted by Restrict Flow are governed exclusively by the terms stated in the signed proposal for that order. Where these Terms and a signed proposal conflict, the signed proposal controls for that order.
2. Engineering content is informational only
The Site contains technical articles, explanations of restriction orifice plate behavior, cavitation and flashing, pressure drop relationships and related fluid-system topics. This content is provided for general information and education. It is not engineering advice, is not a design, specification or recommendation for any particular installation, and is not a substitute for analysis by a licensed professional engineer familiar with your system.
Any sizing estimate, bore calculation, cavitation indication, risk score or similar output produced by a calculator, configurator, questionnaire or automated tool on the Site is indicative only. Such outputs are generated from the data you enter, are not verified by Restrict Flow, and do not constitute an engineering review or a representation that a product is suitable for your application. Formal sizing, cavitation analysis and product recommendations are performed only under a written engagement or a signed proposal.
You are solely responsible for the accuracy of any system data you submit and for any decision you make in reliance on Site content or tool outputs. Restriction orifice plates are pressure-retaining components in industrial piping systems; selection, installation and operation must be performed by qualified personnel in accordance with applicable codes and standards.
3. Submitting system data and inquiries
When you submit a questionnaire, request for information or other inquiry, you represent that you are authorized to share the information provided and that it is accurate to the best of your knowledge. Submitting an inquiry does not create a contract, an engagement, or an obligation on Restrict Flow to respond, quote or perform any service. Restrict Flow will treat submitted system data as confidential business information and will use it only to evaluate and respond to your inquiry, as described in our Privacy Policy.
Do not submit information that is classified, export-controlled, or subject to third-party confidentiality obligations you are not authorized to share.
4. Intellectual property
The Site and its content, including text, technical articles, graphics, drawings, images, video, product designs, part-number schemes, data sheets, logos and software, are owned by Restrict Flow or its licensors and are protected by United States and international copyright, trademark and other intellectual property laws.
"Anti-Cavitate Orifice Plate" and the Restrict Flow name and logo are trademarks of Restrict Flow L.L.C. You may not use them without our prior written consent.
You may view, download and print Site content for your own internal, non-commercial reference in connection with evaluating our products. You may not reproduce, republish, distribute, modify, reverse engineer, create derivative works from, or use Site content for any commercial purpose, or to design, manufacture or market competing products, without our prior written permission.
5. Acceptable use
You agree not to: (a) use the Site in any way that violates applicable law; (b) attempt to gain unauthorized access to the Site, its servers or connected systems; (c) use bots, scrapers or automated means to access the Site or extract content, other than search-engine indexing; (d) submit false, misleading or malicious data through any form or tool; (e) interfere with the operation or security of the Site; or (f) use the Site to transmit spam, malware or unlawful material.
6. Third-party links and services
The Site links to third-party websites and services, including our Shopify store, LinkedIn, trade-publication articles, and Google and Microsoft advertising and analytics services. We do not control and are not responsible for the content, privacy practices or availability of third-party sites. Links do not imply endorsement.
7. Disclaimer of warranties
THE SITE AND ALL CONTENT, TOOLS AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT OR UNINTERRUPTED AVAILABILITY. RESTRICT FLOW DOES NOT WARRANT THAT SITE CONTENT IS COMPLETE, CURRENT OR ERROR-FREE, OR THAT ANY TOOL OUTPUT IS SUITABLE FOR ANY PARTICULAR SYSTEM.
Product warranties, if any, are stated only in the applicable signed proposal or store terms and are not expanded by anything on the Site.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RESTRICT FLOW AND ITS MEMBERS, OFFICERS, EMPLOYEES AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, PRODUCTION, DATA OR GOODWILL, OR FOR ANY DAMAGE TO EQUIPMENT, PIPING OR PROCESS SYSTEMS, ARISING OUT OF OR RELATED TO YOUR USE OF OR RELIANCE ON THE SITE, ITS CONTENT OR ANY TOOL OUTPUT, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL RESTRICT FLOW'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100). THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND DOES NOT MODIFY THE LIABILITY TERMS OF ANY SIGNED PROPOSAL OR STORE PURCHASE, WHICH ARE GOVERNED BY THEIR OWN TERMS.
9. Indemnification
You agree to indemnify and hold harmless Restrict Flow and its members, officers, employees and contractors from any claim, loss, liability or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site, or your reliance on Site content or tool outputs in the design, specification, installation or operation of any piping system.
10. Privacy
Our collection and use of personal information through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference.
11. Changes to the Site and these Terms
We may modify, suspend or discontinue any part of the Site at any time without notice. We may revise these Terms by posting an updated version with a new "Last updated" date. Continued use of the Site after a revision constitutes acceptance of the revised Terms.
12. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Galveston County, Texas, and you consent to the personal jurisdiction of those courts.
13. General
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and Restrict Flow regarding use of the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
